Three medical professionals sued for failing to report a medical malpractice case against an Indiana OB/GYN who is accused of photographing women during examinations

Marion, Indiana – A medical malpractice claim has been made against Dr. William David Moore and 3 healthcare organizations by the attorneys for 83 women.

The doctor from Marion, Indiana, whose license was revoked in March, is accused of taking pictures of women’s genitalia without their consent. Additionally, he is charged with improper conduct during pelvic exams, including failing to wear gloves and requesting unnecessary medical tests.

83 women named Jane Does are listed in the lawsuit that was filed on Friday. It covers each Jane Doe’s age, the alleged time she sought Dr. Moore’s medical attention, and the location of their treatment.

Dr. William David Moore, Dr. Moore’s Women’s Healthcare, Ambulatory Care Center, and Marion General Hospital are the defendants in the medical malpractice lawsuit.

According to the lawsuit, Dr. Moore started providing medical care in Grant County around 1994.

The ladies involved in the complaint range in age from 15 to 73. They interacted with Dr. Moore over the course of his almost three-decade tenure in Grant County.

The lawsuit accuses Dr. Moore’s Women’s Healthcare, Ambulatory Care Center, and Marion General Hospital of neglecting to oversee and keep an eye on Dr. Moore’s operations.

In the lawsuit, it was alleged that Marion General Hospital, Dr. Moore’s Women’s Healthcare, and Ambulatory Care had “actual and constructive knowledge and was on notice of the allegations of medical negligence and abuse of female patients” and “took no effective steps to detect, prevent, or report the negligence, misconduct, or abuse.”

Each healthcare provider is also charged with failing to uphold its obligation to screen and oversee staff, which among other things amounts to a distinct and different conduct of medical malpractice.

According to the lawsuit, the women’s examinations with Dr. Moore caused them emotional hardship, mental suffering, and humiliation.

According to the lawsuit, each act is a unique and individual instance of medical misconduct, and each Jane Doe will pursue all available remedies under the Indiana Medical misconduct Act.

A doctor may be held accountable for up to $250,000 in damages under Indiana’s Medical Malpractice Act in any one instance.

Additionally, the lawsuit claims that the medical malpractice statute of limitations is unconstitutional because the women could not have reasonably been expected to comprehend the severity of what was occurring. According to Indiana law, victims have two years from the incident date to file a claim.

After “Patient A” filed a complaint with the company, she claimed that during an examination in April 2022, Dr. Moore sexually assaulted her and took pictures of her private parts without her consent.

The patient alleged that Dr. Moore handled her privates inappropriately during the examination, took longer than usual to complete it, and inquired about her capacity for sexual pleasure.

Dr. Moore’s lawyer released the following statement in January:

Dr. David Moore was a practicing obstetrician/gynecologist for more than 40 years before retiring at age 76 in December 2022. His medical license was never subjected to any disciplinary action by any state licensing agency during his long career. He cares about his patients and worked very hard to provide them with excellent care. Dr. Moore is prohibited by patient confidentiality laws from discussing the care he provided to his patients or sharing any documents related to their care. Dr. Moore denies the allegations filed by the Attorney General’s office and is prohibited from patient confidentiality laws from commenting further at this time.
